IMPORTANT NOTICE: It is illegal to sell alcohol to people under the age of 18. By placing an order, you must confirm that you are 18 years old or above. You must ensure that no other person except yourself shall use your login to purchase alcohol goods and a person aged 18 or above (identification required) must be present to take delivery, otherwise delivery shall be withdrawn and attempted at another time to be agreed between you and us.

General Terms and Conditions

These terms and conditions shall be applied to all sales and are the basis upon which orders are accepted by Madison Wine Club Limited (MWC). They shall be applied to all sales unless varied in writing to all future transactions.

1. General

1.1. In these terms and conditions and the Special Conditions (as defined below) (collectively referred to as the "Terms and Conditions"), "Madison Wine Club Limited ", "we", "our", "MWE" or "us" means Madison Wine Club Limited, a division of Madison Wine Club Limited and the "customer", "you" or "your" means any person, firm, company or body which places an order with us. Please read these terms and conditions carefully before using the website or our mobile app (as the case may be) (collectively "our e-store"). By using the site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.

1.2 We shall make every effort to ensure that prices, details and sizes of goods at our e-store are up-to-date. Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and stock availability.

1.3. We shall make every effort to ensure goods displayed at our e-store are in stock. If from time to time any goods become out of stock, we reserve the right to offer alternative goods of similar value and style. •

1.4. All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the goods or services requested are unavailable.

1.5. We reserve the right to make changes to these terms and conditions from time to time without providing any prior notification. The amended terms and conditions are effective from the date they are published on our site. Your continued access and use of our site and our services shall represent your unconditional acceptance of the latest version of the terms and conditions.

2. Registration

2.1. You are required to register as a user before placing any order through our e-store. During the registration:

You must provide us with accurate, complete and up to date registration information;
You must safeguard your username and password;
You authorize us to assume that any person using the e-store with your username and password is either you or is authorized to act for you;
We have the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.
2.2. Please inform us via our website/by email at cs@madison-wine.com /by phone at (852) 3101-9883 immediately of any changes to the information that you provided so that we can communicate with you effectively.

3. Orders

3.1. You can place your order by adding your selected goods to the Cart.

3.2. Placing an order means you agree to purchase goods or services in accordance with the Terms and Conditions set out herein. After receiving your order, we will email an order confirmation to you. However, your receipt of a confirmation does not signify we have accepted your order, nor does it constitute as we have confirmed our offer to sell. We are simply confirming that we received your order.

Because we want to ensure that we have your ordered goods available, we won’t accept your order until we have prepared them for delivery. In most cases this will be within 24-48 hours for the item(s) that are in stock. We may, in our sole discretion, refuse or cancel any order and limit order quantity. We may require additional qualifying information prior to accept or process any order. After you receive our email order confirmation, you can check online or contact us at cs@madison-wine.com to track your order status.

3.3. If your order is accepted by us, we will confirm with you within 1-2 working day(s) and advise the date and time of delivery or availability for collection at the warehouse.

3.4. You must ensure all information in your order, including your delivery address and contact details are correct. We will not be liable if we cannot deliver your order, or have to delay delivery, if you have provided incomplete or inaccurate information to us. Please refer to our Delivery Terms for details.

3.5. We reserve the right to reject any purchase order with or without reasons, notably if the goods you ordered is out-of-stock or you have not fully paid your orders, we will notify you by phone or email.

4. Prices

4.1. The prices for your ordered goods are those displayed on this website on the date you place your order, excluding surcharges mentioned in the Delivery Terms section. Despite our best efforts, a small number of our goods may be mispriced. If the correct price of goods we sold is higher than our stated price, we will (at our discretion) either: (a) contact you for instructions before delivery; or (b) cancel your order and notify you.

4.2 We will bill you the surcharges at the rates indicated in our Delivery Terms section, on the date you place your order, based on the size of your order and your expected packaging requirement.

4.3. We have the rights to: (a) modify prices and delivery charges displayed on this website at any time; and (b) cancel your order in case of any clerical, printing or calculation errors.

5. Payment

5.1. Our e-store accepts payment by credit cards, bank transfer, FPS, PayMe.

5.2. Payment methods are subject to changes at any time. Changes made will be announced through email, mail and posted on our e-store.

5.3. All goods prices listed are in Hong Kong dollars. The prices listed in our e-store may differ from the prices of the same goods in any other online channel(s). The applicable price shall be the price listed in our e-store as at the date of purchase.

5.4. Acceptance of orders is subject to our sole discretion. A final receipt will be issued to you when goods are delivered to your address, or goods are collected at our warehouse (as the case may be).

5.5. Under Credit Card Purchase Protection service (e.g. Visa Verification Service, MasterCard Secure Code) customers can enjoy safe and secure shopping by using their own credit card with a specific password or security code. Credit cards used for shopping should be valid and under the purchaser’s own name.

5.8. PayMe

5.9. Where there are surcharges for the order, such charges will be set out separately for your acknowledgment and confirmation prior to proceeding to payment.

 

 6. Delivery terms:

6.1. The customer shall be entitled to FREE delivery to ONE Hong Kong local address per invoice where the total amount exceeds HK$1,500.

6.2. Delivery service is available from 10:30am to 5:30pm from Monday to Friday (excluding Saturday/Sunday and public holidays). All same-day urgent delivery requests will carry a surcharge of HK$300.

6.3. Delivery is limited to Hong Kong Island, Kowloon and New Territories, and is not available to outlying islands, Airport, restricted areas, Discovery Bay and P.O. Box numbers, and is conditional on there being an authorized or legitimate unloading area available.

6.4. For successful order for which payment is received in full between 9:30am – 4pm (Monday – Friday), the estimated time for delivery to your designated address will be 3 to 5 business days depending on the quantity. Once your invoice has been settled in full, we will confirm the expected delivery date and time.

  • We will deliver as scheduled to the best of our ability.
  • Next Day Delivery may be affected due to seasonal factors (e.g. special promotional events) and festive periods (e.g. Christmas or Chinese New Year) as we may need to cope with a higher volume of orders.

6.5. Please check whether all of your purchased goods are delivered against the invoice/delivery note (as the case may be) upon delivery, then sign and return the delivery note to our courier to confirm your acceptance of the goods.

6.6. Should you/a representative not be present to receive the goods as scheduled or the delivery information supplied is incorrect, we reserve the right to charge you an additional delivery fee for subsequent delivery(-ies).

6.7. All expected delivery dates and time are estimates only. We shall not be liable for any loss or damage incurred or suffered by the customer as a result of any late delivery.

6.8. We reserve the right to charge storage fees at our prevailing rates (contact us for more details) in the event that you fail to receive your purchased goods within 30 days of the settlement of your account. In such case, you are required to settle any outstanding fees before you can collect your order.

6.9 Wines may be stored in our warehouse free of charge for up to 14 days from the date of order. Madison Wine reserves the right to charge for storage at cost for any period over 14 days.

6.10. In case of any dispute, our determination shall be final.

For invoices where the total amount is below HK$1,500 delivery charges shall apply as below.

Where the goods to be delivered exceeds 15 cases or is required to be palletized, an external quote for delivery cost will be provided. Please contact our Customer Relations Manager at cs@madison-wine.com to make special arrangements before placing your order.

  • In the event of the breakdown of elevators within either our warehouse or at the Customer address, arrangements would be made to deliver/collect the bottles/cases at another time without surcharges subject to company discretion.
  • Delivery/collection service will be suspended when typhoon signal No.8 or above or a black rain warning is hoisted. In this event Customers will be contacted to re-schedule delivery/collection time without surcharges.
  • Staircase Handling: HK$30/case/floor (where 8 or more stairs per flight is considered one floor).
  • Customer will be responsible for the registration charges/gate charges for warehouses located in Hong Kong.
  • If delivery is delayed, postponed or cancelled due to traffic, weather, different district or other factors, the Company shall not be liable for any loss or damage, no matter whether the factor which causes the delay, postponement or cancellation is within the control of the Company or not.

7. Collection service (applicable if you have selected to collect your order(s) at our warehouse)

7.1. You will be notified via email when your goods is available for collection, including business hours and designated collection date. We reserve the right to transfer uncollected goods to our warehouse for storage and charge storage fees at our prevailing rates, should the 30-day free storage period be expired (contact us for more details). In such case, you are required to settle any outstanding fees before you can collect your order.

7.2. When collecting goods from our warehouse, you or your authorized representative will be required to produce your email confirmation for identity verification. We may require further information to verify your identity (such as your full name or other personal information under your account profile). If we are not satisfied that the person requesting to collect your goods is yourself or your authorized representative, we will refuse the collection in order to safeguard your interest.

7.3. If the warehouse is closed due to weather or any other uncontrollable factors, we will notify you via email as soon as possible and you may collect the purchased goods on the next business day when the warehouse is opened.

8. No return and refund

8.1. Due to the nature of the goods and for safety and hygiene reasons, we do not accept return or refund except:

- item(s) in your order was incorrect or out of stock

- item(s) in your order was damaged upon delivery

8.2. To be eligible for a return, your item(s) must be unopened or unused and in the same condition that you received it. It must also be in the original packaging. Please notify us at cs@madison-wine.com within 2 days after delivery, otherwise we have the right to refuse your claim.

8.3 To process your return, we require your order number, valid reason for the return or refund, and receipt or proof of purchase.

8.4 We will collect the item(s) within 1-2 working day, once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

8.5 If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

8.6 Only regular priced item(s) may be refunded, unfortunately, sale item(s) cannot be refunded.

8.7 Free gift item(s) cannot be returned or redeemed for cash.

9. Uncontrollable force

9.1. If due to any uncontrollable reasons (including fire hazard, injury or death, accident, natural hazard, any law enforced by HKSAR government or departments, order, announcement, rule, regulation or restriction, strike, labour dispute, labour or skilled worker shortage, product or supply shortage, transportation delay or any other reason beyond MWC’s control (no matter the same with the aforementioned)), that made us cannot fulfill the responsibilities stated at this site, we will not be responsible for these areas.

9.2. For the safety of our employees, we reserve the right of stopping delivery service.

10. Privacy protection

We are committed to safeguarding the privacy of individuals with respect to personal data. We therefore make sure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486) under the laws of Hong Kong. Please refer to our Privacy Policy Statement.

11. Disclaimer

11.1. Without violating Article 12 below, any information, data and all content that you can find on our website are provided to you according to their availability, and are not guaranteed in any form, whether explicit or implicit , Including guarantees for goods or for specific purposes and other guarantees.

11.2. We do not represent or warrant that access to our site, or any of its contents will be accurate, uninterrupted, complete, reliable or fault-free.

11.3. Certain legal jurisdictions may not allow specific restrictions on guarantees, therefore some of the above disclaimers may not be applicable to you.

11.4. Any advice or information obtained from us or during the use of the our website services, whether oral or written, does not constitute any guarantee that is not expressively stated in the existing terms and conditions.

12. Limitation of liability

    12.1. The photographs and texts illustrating and describing the goods on this website are non-contractual and for information purpose only. We will not be liable for any error or omission in the photographs or texts displayed on this website.

    12.2. Our total compensation obligation under these Terms and Conditions cannot exceed the amount : (a) we have billed you; or (b) you have paid for your ordered goods (whichever lowest). And we have no compensation, contribution or other obligation for any consequential, punitive, incidental, indirect or exemplary losses.

    12.3.We shall under no circumstances be liable for any loss (whether direct or indirect) of revenue, loss of profits or any indirect or consequential loss whatsoever suffered, sustained or incurred by you or by other person arising (directly or indirectly) out of the sale and purchase transaction with you.

    12.4. For any ordered goods remain undelivered for 30 days from the date of an order confirmation or storage fees remain unpaid for over 30 days, we shall have the right to dispose of such goods at our own discretion without further notice to you. In such event, we shall not be liable to make any refund or compensation to you; and we reserve the right to continue claiming you for the outstanding storage fees.

    12.5. We will not be liable if we fail to perform any of our obligation under these Terms and Conditions resulting from circumstances beyond our reasonable control, including internet system failure, computer glitch and hacking.

    12.6. We shall not be liable for any delay or failure to perform caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond our control.

    13. Promo codes

      13.1. To apply a promo code, you must enter it prior to completing your order. You may apply a promo code once only and cannot apply to previously placed orders. Promo codes that offer a percent off may not be used in combination with other discount or promotion.

      13.2. Promo codes are not transferable or redeemable for cash or credit.

      13.3. Certain goods are excluded from promo code. You should check the specific details of the promo code to which the products it applies to. We have the right to cancel your order if you apply promo code to excluded or wrong goods.

       14. Others

        14.1. Basis of supply: we only serve and deliver goods to end consumers. We are not selling our goods for re-sell purpose. If we have grounds to believe that you are not purchasing our goods as an end user, we reserve the right to decline or cancel your order.

        14.2. You shall not assign, transfer or otherwise any of your rights and obligations under these Terms and Conditions to any other third party without our prior written consent.

        14.3. If any provision of these Terms and Conditions shall be construed to be illegal or invalid, they shall be removed from these terms and it shall not affect the legality, validity and enforce ability of the other provisions of these Terms and Conditions.

        14.4. These Terms and Conditions embody the entire agreement between the parties and they supersede all previous negotiations, representations and agreement between the parties.

        14.5. Title to the goods shall remain vested in us until we receive full payment of the price, and risk shall pass to the customer upon delivery / collection of the goods (as the case may be).

        14.6. If any dispute arises, our determination shall be final. Where these Terms and Conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.

        15. Laws applicable

          These terms and conditions are governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region. The courts of the Hong Kong Special Administrative Region shall have jurisdiction over disputes over these terms and conditions.
